1v1stream Terms of Service

1. Acceptance
By accessing or using 1v1stream, you agree to these terms. If you do not agree, do not use the service. These terms apply whether or not you create an account.
2. You must be 18 or older
1v1stream is an adults-only platform. You must be at least 18 years old to create an account, appear on camera, vote, or use chat. When you create an account you will be asked to confirm your date of birth, and by doing so you represent that the information is accurate and that you meet this requirement. Accounts belonging to anyone under 18 will be terminated. You may not bring anyone under 18 into view of your camera at any time, for any reason. Because broadcasts may be recorded and published, we treat violations of this section with particular seriousness.
3. Your account
You are responsible for everything done under your account and for keeping access to your email secure. One account per person. You may not sell, rent, transfer, or share your account with anyone else. Do not impersonate anyone, including through your display name.
4. How the service works
Two performers appear on camera at a time. Viewers vote, and at the end of each round the performer with fewer votes leaves the stage and the next person in the queue takes their place. Queue position, round timing, and stage occupancy are determined by our systems, and we may change how any of it works at any time.
5. Your content and the licence you grant us
You keep ownership of the content you broadcast, write, and send.
By using 1v1stream, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully sublicensable and transferable licence to record, store, host, reproduce, edit, adapt, excerpt, combine with other material, translate, publish, publicly perform, publicly display, and distribute that content, in whole or in part, in any media now known or later developed, for any purpose — including operating, promoting, advertising, and marketing the service.
This licence expressly includes the right to publish recordings and clips on our own social media accounts and on any third-party platform, and to use your display name, voice, image, and likeness in connection with that content for promotional purposes.
This licence is granted the moment you appear on camera or send content through the service. It is perpetual and cannot be withdrawn. It survives the termination or deletion of your account and any change to these terms.
We may exercise these rights without any payment to you, and without any obligation under any collective bargaining agreement, guild arrangement, residual, or royalty scheme.
You represent and warrant that: you own or otherwise control all rights necessary to grant this licence; your content does not and will not infringe or violate anyone else's rights, including copyright, trademark, privacy, and publicity rights; you have obtained the consent of every identifiable person appearing or audible in your content to their appearance being recorded, published, and used as described here; and your content does not defame anyone or contain malicious code. To the extent permitted by law, you waive any moral rights you hold in that content.
6. Being recorded and published
When you go on camera you consent to your audio and video being transmitted live to a public audience, and to being recorded, stored, edited, and published by us under the licence in section 5. There is no opt-out. If you do not want to be recorded, do not go on camera.
We may record events by capturing the stage area of the screen during a broadcast. Chat is not included in what we record. Recording does not happen for every event, and we do not guarantee that any particular broadcast will or will not be captured.
You are responsible for what your camera and microphone capture. Do not broadcast anyone who has not agreed to appear. Be aware that people audible in the background will be recorded — in Maryland and several other states, recording someone's conversation without their consent is unlawful, and that responsibility is yours.
Viewers may additionally record or reshare what they see using tools outside our control, including chat that we do not ourselves record. We do not prohibit this and we do not grant them any right to do so — what a viewer does with a recording is a matter between that viewer and you.
7. What you may not do
You may not: appear nude or engage in sexual conduct on camera; harass, threaten, or incite violence against anyone; broadcast illegal activity; broadcast anyone who has not consented to appear, or anyone under 18; infringe copyright or trademark, including by playing music you do not have the rights to; impersonate others; manipulate voting through multiple accounts, coordinated behaviour, or automated means; access the service through automated means or attempt to bypass any technical restriction; interfere with the operation of the service or any other person's use of it; collect other users' personal information without their consent; or use the service for any unlawful purpose.
8. Moderation
We may remove you from the stage, remove you from the queue, suspend or terminate your account, block your access, or remove any recording from publication, at our discretion and without prior notice, including for conduct we judge harmful to the platform or the people using it. We are not obligated to give a reason, and we do not review content before it is broadcast. Nothing in these terms obligates us to publish, keep publishing, or preserve any particular recording. We are not responsible for content contributed by other users, and we do not endorse it.
9. Security of your content
We take reasonable measures to protect content on the service from unauthorised copying and distribution. We cannot and do not guarantee that unauthorised copying, capture, or redistribution by third parties will not occur. To the fullest extent permitted by law, you agree that we are not liable for any unauthorised copying, use, or distribution of content by third parties, and you release us from any claim arising from it.
10. Copyright complaints
If you believe content on 1v1stream infringes your copyright, send a notice to admin@1v1stream.com including: identification of the work, identification of the infringing material, your contact information, a statement of good-faith belief that the use is unauthorised, and a statement under penalty of perjury that your notice is accurate and that you are authorised to act on the owner's behalf. We terminate the accounts of repeat infringers.
11. Feedback
If you send us ideas or suggestions about the service, we may use them freely, without compensation, credit, or any obligation of confidentiality to you.
12. The service is free
1v1stream currently costs nothing to use, and there are no payments to or from users. You are not entitled to payment for content you contribute or for its use under section 5. If we introduce paid features, we will update these terms and give notice before the change takes effect.
13. Changes to these terms
We may change these terms. When we do, we will update the date above and post the revised terms on this page. If a change is material, we will give notice by email or through the service before it takes effect. Continuing to use 1v1stream after a change takes effect means you accept the revised terms. If you do not accept them, stop using the service.
14. No warranties
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be available, uninterrupted, secure, or free of errors, or that any defect will be corrected.
15. Indemnification
You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, damage, cost, or expense — including reasonable legal fees — arising out of or related to: your use of the service; any content you broadcast, send, or otherwise contribute; your violation of these terms; your violation of any law; or your violation of anyone else's rights, including privacy, publicity, and intellectual property rights.
16. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of profits, goodwill, or data, arising out of or relating to the service. We are not liable for the conduct of any user of the service, or for anything a third party does with content captured from it. Our total liability for any claim relating to the service will not exceed one hundred US dollars.
17. Resolving disputes
Before starting any legal proceeding, email admin@1v1stream.com describing the dispute and what you want. We will have 60 days from receipt to try to resolve it with you. Any claim relating to the service must be brought within one year after it arises, or it is permanently barred, to the extent the law allows. These terms are governed by the laws of the State of Maryland, without regard to its conflict of law principles. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Maryland.
18. Ending your use
You may stop using the service at any time. We may suspend or terminate your access as described in section 8.
19. General
Sections that by their nature should survive termination will do so, including sections 5, 6, 9, 11, 14, 15, 16, 17, and 19. If any provision of these terms is held unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect. If we do not enforce a provision, that is not a waiver of our right to enforce it later. You may not transfer or assign these terms; we may assign them without restriction, including in connection with a merger, acquisition, or sale of assets. These terms, together with our Privacy Policy, are the entire agreement between you and us about the service.
